Building Certification Services

Building Approvals Unit

The Building Approvals Unit of the Sydney Olympic Park Authority provides a regulatory function that aims to provide efficient, cost effective approvals, building certification and building inspection services. The Building Approvals Unit can offer a range of quality building and development related services. These services relate to:

  • issue of construction certificates (see below) for all types and classes of buildings
  • inspection of building works during the course of construction and undertaking of Principal Certifying Authority (see below) services
  • building and development advice during the course of construction
  • advice on the requirements for access for persons with a disability including the specific requirements of the Authority's Access Guidelines
  • issue of occupation certificates upon completion of the development or building work
  • advisory and consultancy services encompassing building approvals and certification, pre-lodgement advice, general advice relating to development consents and modifications to consents, building inspections and principal certifying authority services, fire safety, construction site management, compliance with development consents, accessibility advice, legislation and technical issues relating to the Building Code of Australia.

Please note that at this point in time, the Building Approvals Unit can only provide these services to developments located within the boundary of Sydney Olympic Park.

What is and who can issue a Construction Certificate?

A Construction Certificate is an approval that:

  • ensures that if the building is erected in accordance with the approved plans and specifications, will comply with the technical requirements of the Building Code of Australia (BCA) and any relevant Australian Standards
  • certifies that the detailed plans and specifications are not inconsistent with the Development Consent
  • certifies that the relevant development consent conditions have been complied with
  • certifies that other relevant legislative provisions have been met
  • certifies that all required contributions and fees have been paid.

Conditions of consent cannot be re-imposed on a construction certificate. Therefore, plans and specifications must be fully detailed.

A Construction Certificate (or CC) can be obtained from the Building Approvals Unit or a private Accredited Certifier. If the Construction Certificate is issued by a private Accredited Certifier, a copy of the certificate, associated plans and specifications must be forwarded to the Authority within seven (7) days of issue.

Building works can commence after the construction certificate has been obtained and a Principal Certifying Authority (PCA) has been appointed. Upon completion of the building work, an occupation certificate is obtained from the PCA.

What is a Principal Certifying Authority?

Having obtained development consent and then a Construction Certificate, the applicant is required to appoint a Principal Certifying Authority (PCA) prior to commencing any building work. Either the Authority or a private Accredited Certifier may be appointed as the PCA. 

If the Authority is not the PCA, the Authority must be notified of who has been appointed at least 2 days prior to building work commencing.

What is the role of the Principal Certifying Authority?

A PCA is the person (or Authority) responsible for ensuring compliance with the construction certificate, the BCA and other applicable requirements during the construction process. The PCA also checks compliance with the requirements of any development consent.

The PCA is required to:

  • conduct an inspection of each required critical stage of construction
  • promptly advise the applicant, after any relevant inspection, of any outstanding work
  • issue the applicant an Occupation Certificate (see below) for any building work or change of building use when the relevant application has been lodged with the Authority, and all the required works and conditions of the Development Consent have been completed.

A PCA cannot be replaced by another PCA on a development, except with the specific written consent of the relevant PCA accreditation body.

Where residential building work is concerned, the PCA must be provided with details of the licensed building contractor and copies of any required home warranty insurance details, in accordance with the requirements of the Home Building Act 1989 and Environmental Planning & Assessment Act 1979.

What is an Occupation Certificate?

An occupation certificate certifies that the building or nominated part of the building is safe and suitable to be occupied. The occupation certificate must be obtained from the PCA prior to the occupation of a new building (or part of a building).

Prior to issuing an occupation certificate, the PCA must be satisfied that the construction works satisfy the:

  • legislative requirements
  • conditions of  the development consent
  • and the building or nominated part of the building is safe and suitable for occupation under the requirements of the BCA.

Service Fees

Fees for Building Approvals Unit's services are in most cases based upon the contract price of the building works proposed, which are very competitive. However, the Building Approvals Unit can also provide project specific fees upon request.
